Parenting and Place of Residence

A child’s right after divorce is to continue to have two parents.  Collaborative family attorneys work to preserve both mothers’ and fathers’ rights to raise their children. Unless there is a history of domestic violence, a high-conflict divorce, or a child is under guardianship with a third party, most parents will choose to share physical custody.  Judges and collaborative divorce attorneys frown on the idea that parents have visitation with their own child.    

Divorce law requires a parenting plan when parents share physical custody.  One parent’s home is designated the child’s place of residence.  The parenting plan the parties create with the legal advice of their collaborative divorce team divides the parents’ time with their child in the best interests of the child and family.
